California Nursing Home sued after resident fell to death

The Kindred Healthcare Center of Orange was sued for negligence when the bed alarms placed for a patient's security after a fall were frequently not turned on. The bed alarms were installed to notify the staff when the patient got out bed without assistance so that he would be at less of a risk to have a subsequent fall. Floor mats which were also placed around the bed for the patient's protection were removed after only one week. On July 14, 2009, a nursing assistant found the patient after a fall and was unable to determine how long the patient had been there. Ultimately Kindred was fined $85,000.00 and issued a citation.
