A Virginia man will be facing trial for accusations of elder abuse and neglect of his 86-year-old mother that eventually lead to her death.
According to an article on the Richmond Times Dispatch, 57-year-old Richard Lee Wallace was responsible for the care of his elderly mother, Elsie Wallace. Wallace had lived with his mother for the majority of his adult life and began taking care of her finances in 2008. Two years later, the elderly woman, who had Alzheimer's, had lost the ability to walk and relied solely on her son for care and assistance. The last few months of the elderly woman's life were spent on a torn-up couch in the home, which is exactly where officers found her body when they were dispatched to the home.
Upon arrival, officers found the elderly woman, who had been deceased for no longer than an hour, covered in flies with bedsores that were filled with maggots. Upon further investigation, the cause of death was the direct result of a bacterial infection in the blood caused by gangrene. Wallace's elder abuse trial is currently underway and expected to come to a close this week.

Witnessing or suspecting nursing home elder abuse in California can be quite stressful, especially if the victim is a friend or loved one. While both victims and their family members are aware that they should report the abuse, speaking to someone about the matter can be both humiliating and devastating.
Thankfully, a new California state law will make reporting nursing home elder abuse easier. As of January 1, 2012 California nursing home employees, residents and their family members will be able to report instances of elder abuse through a confidential internet system.
Unlike the previous method of having to call a dedicated phone line, those who are reporting abuse do not having to wait to speak with someone in order for the abuse to be reported. According to an article on the Record Gazette, in November 2010, 27% of callers hung up rather than wait on the line to report abuse, leaving the victims to continue to suffer and not receive the care and medical attention that they may need.
This new law will help not only prevent individuals from not reporting nursing home elder abuse, but it will also allow those who may be shy or embarrassed to gain confidence in using the new reporting system.

Nursing home elder abuse seems to be on the rise as more and more families cannot take care of their elderly relatives and are being forced to rely on the care and medical assistance of nursing home caregivers. Unfortunately, many nursing homes are failing in providing adequate care and in some cases, causing the residents harm.
According to an article on the Star Tribune, Georgia Anetzberger, president of the National Committee for the Prevention of Elder Abuse has been quoted saying "the spread of cameras in nursing homes is part of a broader proliferation of video surveillance in society to catch anything from traffic violations to shoplifting" .
Very few states currently have laws allowing family members to install cameras inside their love one's nursing home room. However, this does not stop many individuals from installing these "granny cams", especially when they suspect nursing home abuse.
In several instances, these cameras not only may have saved lives but they have helped prevent future cases of nursing home elder abuse from occurring. An Ohio man was able to catch two nursing home caregivers abusing and hitting his 78-year-old mother who suffers from Alzheimer's while a New Jersey nursing home was found to be abusing an 87-year-old woman which then prompted a wrongful-death lawsuit. In New York, 22 nursing home workers were arrested for the maltreatment of residents after they were caught victimizing the residents on camera.

If you suspect or have witnessed any type of elder abuse, contact our California Elder Abuse Attorneys as soon as possible. We will ensure that the nursing home or caregiver is held responsible and that the victim receives the compensation that they deserve for their pain and suffering.
Any type of elder abuse can be both frustrating and heartbreaking to suspect or even witness. Unfortunately, more and more elder residents are being victimized in nursing homes or care facilities and do not have the courage to tell anyone about the abuse. Because of this, it is critical that the friends and family members of those who reside at any type of assisted care facility stay in constant communication and report any form of elder abuse to local officials as well as a dedicated California Elder Abuse Attorney.
As the economy continues to spiral downwards, financial elder abuse seems to be on the rise. Most elder individuals entrust their care to their caregivers, friends or even family members without realizing the potential harm that the person may cause in an act of desperation. Although an elder resident may not have the means to constantly check their credit card or bank card statements, a bill that was passed in 2005 requires bank employees to notify authorities if financial abuse is suspected.
According to Mercury News, from 2007 to 2010, the Financial Elder Abuse Reporting Act has helped bank employees to report over 26,000 cases of elder financial abuse in California alone; confirmed cases of financial abuse rose by 16.4% in just the first year and were even higher the following years.
Financial elder abuse can occur in many different forms such as scamming, stealing, manipulation or even by using threats. If you have been the victim of elder abuse or suspect a loved one of being victimized financially, contact our California Elder Abuse Attorneys immediately. We will help investigate the case and we will provide you with answers to any questions that you may have and will represent you until you receive the compensation that you deserve.
A Los Angeles woman is taking matters into her own hands by testifying for a new bill in Sacramento after her mother was the victim of financial elder abuse.
According to the Topanga Messenger, Liz Sanders, of Woodland Hills, is hoping that the new bill, which would put new regulations for the issuance of "signature stamps", will help prevent other elder individuals from becoming victimized.
Sanders' mother, Bette Isenberg who died last year at the age of 82, was bedridden and needed to receive constant care and therefore, had a caregiver named Helen Wofford. Unfortunately, the caregiver financially abused the elderly woman by using signature stamps to "cash checks, drain her bank account and access her life insurance fund". On top of this, the caregiver utilized the stamps to add herself to the elderly woman's Neiman Marcus and Saks Fifth Avenue accounts and proceeded to charge over $80,000. Although Wofford was convicted and sentenced to 2 ½ years in prison, Sanders believes there could be others out there, entrusting their care to a person who may not have the best intentions.
If someone you know is a resident at a nursing home or has a caregiver, it is imperative that you learn the signs of elder abuse and stay in constant communication with your friend or loved one. If you suspect or have witnessed elder abuse, contact our California Elder Abuse Attorneys today.

A new California bill has been introduced specifically with elder abuse victims in mind.
According to California Healthline, nursing employees as well as social, health and law enforcement employees will have to inform both an ombudsman and local law enforcement if elder abuse is suspected. Assembly member Mariko Yamada (D-Davis) introduced the bill because the current bill only required employers to report to one agency or the other, not both.
On top of this, another bill ( SB 558) was passed by Sen. Joe Simitian (D-Palo Alto) to help lower the " burden of proof in elder abuse cases". This means that the evidence needed to convict one of elder abuse will not be as strict as it used to be.
If you suspect or have witnessed elder abuse, it is imperative that you report the abuse to the nursing home staff members as well as the local police department if the abuse is life threatening. Contact a qualified and knowledgeable California Elder Abuse Attorney today.

Elderly individuals often entrust a nursing home to take care of them, provide them with daily necessities as well as proper medical treatment. Unfortunately, many nursing homes fail to uphold their promises and cause their residents to become victims of elder abuse.
Our elder abuse lawyers understand the dangers of elder abuse and are here to provide you with information that can help you discover elder abuse. One type of elder abuse that causes serious health risks is neglect as it can lead to bedsores.
Bedsores are a painful pressure ulcer that can occur on any part of the body, especially around areas such as elbows, knees, ankles and sacrum/tailbone. Especially common in patients that are bedridden or confined to wheelchairs, bedsores can occur and spread quickly, but if caught early on, they are easy to treat.
Typical causes of bedsores include:
- Unrelieved pressure
- Friction between bed/skin
- Humidity/temperature
- Shearing forces
Our Elder Abuse Attorneys know that the easiest way to prevent bedsores from occurring is to ensure that the elderly resident receives the proper bedsore care and does not stay in one position for a long period of time; turning the patient at least every two hours will help avoid bedsores from forming or getting worse.
On top of this, it is the nursing homes obligation to provide the patient with a clean and sanitary room and ensure that excess moisture from incontinence, perspiration or fluids from other lesions are taken care of immediately. Moisture can aggravate current bedsores or cause new ones to form. If left untreated, bedsores will turn into open wounds, become infected and can lead to death. A California Elder Abuse Attorney will be able to provide you more information regarding elder abuse laws that may help take your case to court.
It is imperative that if you notice any sign of bedsores, that you contact the nursing home staff doctors or nurses. If the bedsore does not improve, contact the local police department for immediate medical attention.
