Former aide charged with molesting residents at California home for the disabled

Curtis Cortez was charged with molesting two female residents. He is being held on $100,000 bail and was arrested on felony counts of lewd and lascivious acts. Cedars of Marin, the home for the disabled where this occurred had previously warned Cortez against hugging patients or giving back and shoulder rubs. Cortez claimed this was part of his "Hawaiian Culture" but also admitted to having trouble with his girlfriend and touching one woman's breasts and genitals. Sadly, these acts of California nursing home abuse are all too common. Failure on the part of the nursing home to properly manage its staff can have devastating consequences. If you or a loved one has been the victim of California elder abuse the first thing you should do is contact a qualified nursing home abuse attorney who can fight to get you the compensation you deserve.

Nursing Home Staff Missed Red Flags in Woman's Death

A nursing home resident was strangled to death by her roommate and her son claims that the nursing home staff missed red flags. The district attorney on this case recently revealed that the victim had previously complained about her roommate making her life "a living hell." Also the night before the death, the roommate had punched a nursing assistant. The victim was found strangled and suffocated at Brandon Woods Nursing Home. This tragic case of elder abuse and neglect is still being investigated. Nursing home abuse throughout the United States is all too common these days as many red flags are being overlooked as nursing homes are understaffed or not properly trained. Losing a loved one to California nursing home abuse is emotionally difficult for anyone. While nothing can make up for losing a loved one, you can receive compensation for the nursing home abuse or neglect to pay for any financial burdens the death may have brought. You will want to contact a California nursing home abuse law firm for further help in pursuing a case against a nursing home and holding the guilty party responsible for their abuse or neglect.

Nursing Home Abuse in Fallbrook leads to high Fine

A resident of the Fallbrook hospital District Skilled Nursing Facility died shortly after falling due to complications from a surgery. The nursing home was fined $90,000 and given a AA citation (the most severe available) when it failed to implement a plan to prevent the fall. The resident was considered to be at a high risk for falling yet expected measures to keep him from falling were not adhered to. A California nursing home has a duty to maintain the same standard of care that all other nursing homes would implement in like or similar circumstances. Failure to maintain that standard of care can result in negligence charges. Here, the California Department of Public Health stepped in and took action against the nursing home at fault. Many times seniors are unable to speak out against people who are not properly caring for them. In order to prevent further wrongful deaths, it is important that you contact a qualified California nursing home abuse attorney who can hold those responsible for wrongdoing liable. Contact our nursing home abuse and neglect lawyers today for a free case consultation.

Psychological Abuse Takes Its Toll on Residents

Nursing home abusers often carefully choose their victims.  The most likely victim is the resident who is the weakest or the easiest to intimidate.  If the abuser suspects that any resident can be intimidating into not reporting the abuse, chances are that this resident will end up being one of the abuser’s victims.  Residents who have limited movement are also a target for nursing home abusers.  These residents cannot fight off the abuser or make a sudden move for the nurse’s call button or a telephone.  Contact a San Diego nursing home abuse attorney if you suspect that a family member has been the victim of psychological nursing home abuse.  Abusers use psychological abuse for several reasons.  It may be used in combination with physical abuse in an attempt to silence the abused residents.  Psychological abuse can also be used alone if physical abuse would be too obvious and easy to catch by supervisors or visitors.  A Los Angeles nursing home abuse lawyer can tell you the correct actions to take if you find that a loved one has been abused by a nursing home staff member.

Reports of Sexual Abuse May Shock You But You Need to Follow Up

Sexual abuse is more common than anyone might believe.  Nursing home employees who like to abuse residents as a means of coping with their own lives or working out their frustrations are not above resorting to sexual abuse of nursing home residents.  When your loved one reports sexual abuse, you may want to believe that they are mistaken because you don’t want to have to believe that someone charged with their care violated them sexually.  However, you must listen to the claims of your family member so you can be sure they are investigated thoroughly.  Reports of sexual abuse may include claims of sexual contact or even rape.  Other sexual abuse can include posing residents for sexual photographs or forcing residents to disrobe against their will when it is not for a shower or other accepted procedure.  If your loved one trusts you enough to report abuse, keep their needs in mind and make sure their claims are investigated.  You can report abuse to administrators, but they may be unwilling to investigate.  Law enforcement officers and social service agencies can also handle claims of nursing home abuse that involves sexual misconduct.  If your loved one has been the victim of sexual abuse, contact a Los Angeles nursing home abuse attorney to find out how you can prevent further abuse.

Residents Reporting Psychological Abuse May Make Subtle Statements

.  Psychological abuse can run the gamut from name calling to taunting and everything in between.  Psychological abuse is often used for control purposes so that residents will break down and do what they are instructed to do by nursing home employees.  Psychological abuse can also be used to humiliate residents and make them feel like they are not even human.  Because psychological abuse can be so psychologically damaging, residents who have experienced this type of abuse may exhibit new behaviors before they report abuse.  These behaviors can include crying, acting aggressively, being afraid to socialize with others, and a number of other negative emotions.  When you do receive a report of abuse, your loved one will probably not come out and say they were a victim of abuse.  They may make subtle statements or mention that a staff member isn’t well-liked.  If you hear this kind of information, you should contact a Riverside nursing home abuse lawyer so you can make sure your loved one stays safe in their nursing home.

Residents with Special Needs May Be Neglected More Often

Some nursing home residents are able to do many things on their own and are in a nursing home because they need help with a medical condition or just can’t live alone due to their medical needs.  Other residents are in nursing homes because they have extensive medical and psychological needs that cannot be cared for by family members who are not trained medical professionals.  When an employee is faced with caring for several residents with a high level of needed care each shift, resentment and frustration can build up because of the number of things that must be done for each resident.  Employees may be frustrated further if their colleagues seem to get the residents with little need for extensive care while they must provide round the clock care for their patient loads.  When this frustration exceeds a certain level, employees may take it out on residents by yelling at them, becoming physically forceful, or by expressing their anger verbally.  This is unacceptable in any nursing home, so contact a California nursing home abuse attorney to find out what you need to do to take action against the nursing home facility.
